Terms of Service

1. Acceptance of Terms

By installing, accessing, or using the CouchCritic Chrome extension ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. CouchCritic is operated by Himanshu Batra ("we," "our," or "us").

2. Description of Service

CouchCritic is a Chrome extension that adds a comment overlay to streaming platforms including Netflix, Amazon Prime Video, and more. It allows users to post comments, reply to others, vote on comments, and report inappropriate content. The Service includes free and paid subscription tiers.

3. Account Registration

• You must sign in with a valid Google account to use commenting features.
• You are responsible for all activity that occurs under your account.
• You must be at least 13 years old to use the Service.
• You agree to provide accurate information and keep your account secure.

4. User Conduct

You agree NOT to:

• Post content that is hateful, threatening, harassing, defamatory, obscene, or otherwise objectionable
• Impersonate any person or entity
• Spam, flood, or post repetitive content
• Post spoilers without using the spoiler tag feature
• Attempt to circumvent rate limits, bans, or moderation decisions
• Use automated tools, bots, or scripts to interact with the Service
• Interfere with or disrupt the Service or its infrastructure
• Violate any applicable laws or regulations
• Collect or harvest data about other users

5. Content Ownership and License

You retain ownership of the comments and content you post through CouchCritic. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and moderate your content as part of operating the Service.

We reserve the right to remove any content that violates these Terms or our community guidelines, without prior notice.

6. Moderation and Enforcement

• Comments are subject to automated moderation (AI content filtering) and community reporting.
• We may hide, remove, or delete comments that violate our guidelines.
• Repeated violations may result in temporary or permanent account suspension.
• Users who are shadow-banned (reputation below -20) will have their comments visible only to themselves.
• Moderation decisions are at our sole discretion and are final.

7. Subscription Plans and Payments

7.1 Free Tier

The free tier includes 3 comments per day, 1 reply per day, and the ability to read all comments and vote.

7.2 Paid Subscriptions

• Basic ($2.99/month): Unlimited comments, 5-minute edit window, Subscriber badge, spoiler-free mode
• Premium ($5.99/month): Everything in Basic plus 30-minute edit window, Premium badge, early access to new features

7.3 Billing

• Payments are processed securely by Stripe.
• Subscriptions are billed monthly and auto-renew until cancelled.
• You may cancel your subscription at any time. Access continues until the end of the current billing period.
• No refunds are provided for partial months.
• We reserve the right to change pricing with 30 days notice.

8. Third-Party Services

CouchCritic interacts with the following third-party services:

• Streaming Platforms: CouchCritic operates as an overlay on streaming pages (Netflix, Amazon Prime Video, etc.). We are not affiliated with, endorsed by, or sponsored by any streaming service.
• Google Firebase: For authentication and data storage
• Stripe: For payment processing

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or compatible with all versions of supported streaming platforms or Chrome. We are not responsible for any changes streaming platforms make that may affect the functionality of CouchCritic.

10. Limitation of Liability

To the maximum extent permitted by law, CouchCritic and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of revenue, or interruption of service.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may stop using the Service at any time by uninstalling the extension and requesting account deletion. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
